Outputs from AgedCareAI are generated using artificial intelligence and may contain errors, omissions, hallucinations, inaccuracies, outdated information, or content that is incomplete, misleading or unsuitable for a particular situation. Outputs may vary between uses, even where the same information is entered.
Decision support only. Outputs are decision support information only. They do not constitute clinical, medical, nursing, allied health, pharmaceutical, regulatory, compliance, legal, financial, accounting or other professional advice, and are not a substitute for the skill, judgement, assessment or documentation of a qualified professional.
Verification. Users must independently review and verify all outputs against source records and applicable laws, standards, policies and clinical guidelines before relying on them. Outputs must not be copied into care records, care plans, reports or regulatory submissions without review by a suitably qualified person.
Provider responsibility. Providers are responsible for their own compliance with all laws and standards that apply to them, including the Privacy Act 1988, the Australian Privacy Principles, applicable aged care legislation and the Aged Care Quality Standards. They are also responsible for their own privacy policy and AI usage policy, for informing residents, clients and their representatives about the use of AI, and for training their staff to use AgedCareAI appropriately.
Third party services. AgedCareAI relies on third party technology, including Microsoft Azure AI services. We do not control third party services and are not responsible for their availability, performance, accuracy or changes.
Availability. AgedCareAI is provided “as is” and “as available”. We do not guarantee that it will be uninterrupted, error free, or free from harmful components.
Exclusion of warranties and liability. To the maximum extent permitted by law, Innovation Philosophy and its directors, officers, employees, contractors and suppliers exclude all warranties, representations and conditions, whether express or implied, including as to accuracy, reliability, completeness, quality, availability and fitness for any particular purpose. To the maximum extent permitted by law, they are not liable for any loss or damage of any kind, including direct, indirect, incidental, special or consequential loss, loss of data, loss of profit or goodwill, or any harm to a person, whether arising in contract, tort (including negligence), statute or otherwise, in connection with the use of, or reliance on, AgedCareAI or its outputs, including loss arising from human or computer error, interruption, or the actions or decisions of any user or third party.
Australian Consumer Law. Nothing in this disclaimer excludes, restricts or modifies any right or remedy, or any guarantee, condition or warranty, that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law. Where liability cannot be excluded, it is limited, to the extent permitted by law, to resupplying the service or paying the cost of resupplying it.
Governing law. This disclaimer is governed by the laws of New South Wales, Australia.
